Munich – Success of the Ochsenbraterei in court!

The owner of the Oktoberfest, Antje Schneider (53), appeared before the Munich Regional Court I with her complaint about the failure of the Oktoberfest 2020. Judge Martin Scholz had sentenced the insurance company “Direktion für Deutschland” to pay 513,000 euros to the Ochsenbraterei as compensation for the canceled Oktoberfest last year.

Ochsenbraterei pay a premium of about 60,000 euros a year for cancellation insurance. Maximum sum insured: 5.2 million euros. In this case, however, the Ochsenbraterei had sued for just over 2 million euros. “This is the real damage caused by the cancellation of Wiesn 2020, which is also confirmed by a report,” explained Martin Scholz.

Damage insurance is shared between four insurance companies. The Ochsenbraterei had submitted a claim for a quarter of the sum to one of the insurance companies. But the decision is binding for the full damage. “If this ruling becomes final, Ochsenbraterei can also claim the remaining 1.5 million euros from the other insurance companies,” the judge explained.

The insurance “Management for Germany” had initially refused to pay. Because: The insurance period only applies to the period between July and October 2020. However, the Wiesn had already been canceled in April. Therefore, the Ochsenbraterei did not receive any approval for the Wiesn 2020. Therefore, the insured event did not occur at all.

“I see it differently,” Judge Martin Scholz said. He agreed with landlady Antje Schneider, who had not come to the hearing. “It is event cancellation insurance. The fact that Oktoberfest could not take place was not the fault of the Ochsenbraterei.” And he added: “I don’t remember any Wiesn without the Ochsenbraterei. If there had been an Oktoberfest in 2020, I would surely have had a roast beef.”

Oktoberfest host Edi Reinbold (79) is also suing Ergo Versicherung with his Schützen-Festzelt OHG for lost revenue due to the cancellation of Oktoberfest 2020, demanding up to €4 million. But this procedure is suspended until a similar claim for damages by the Wiesn presenter Hans Stadtmüller (Fischer Vroni) has finally been decided before the OLG. A total of seven owners want to enforce the demands for the unusual Wiesn 2020.
