The Federal Financial Supervisory Authority (Bafin) processed 410 complaints about German legal protection insurers last year. This can be found in the authority’s company-specific complaint statistics, which the supervisory authority published in mid-May.
The number of complaints decreased again
Thus, the number of complaints in the division decreased significantly (minus a fifth) for the second time in a row (VersicherungsJournal June 21, 2021, June 23, 2020) after two previous strong increases. Very low reporting rate in judicial protection

The legal defense insurers with the highest fees
A total of 30 (2020: 35) legal protection insurers are listed in the reporting statistics. Among those listed with a contract portfolio of more than 85,000, values of more than two claims are calculated for every 100,000 risks insured for a total of eight providers.
The highest rates, each with almost five claims per 100,000 insured risks, are recorded by the two medium-sized companies WGV-Versicherung AG (24 claims with a portfolio of 485,000) and Itzehoer Versicherung/Brandgilde von 1691 VVaG (16 with almost 345,000) . It is followed by Arag SE with 2.7 (55 complaints with almost 1.7 million risks).

There are some notable changes compared to the previous year. The volume of complaints at WGV tripled from eight to 24. At Arag, on the other hand, there were only about half as many complaints as the year before.
This is how the giants of the industry fought
Of the ten largest companies with more than a million risks insured (03/07/2022), half performed better than the industry average. The lowest value is calculated for ADAC Versicherung AG at 0.3 (31 entries with a portfolio of around ten million). Otherwise, only Huk-Coburg-Rechtsschutz-Versicherung AG (15 claims for almost 1.9 million risks) remained under one.
Örag Rechtsschutz-Versicherungs-AG (21 complaints with a portfolio of more than two million), Ergo Versicherung AG (20 with almost 1.9 million) and Allianz Versicherungs-AG (28 with almost 2.6 million).
Things were slightly worse than in the industry for Deurag Deutsche Rechtsschutz-Versicherung AG (15 entries for more than 1.1 million risks), Roland Rechtsschutz-Versicherungs-AG (27 for 1.7 million) and Advocard Rechtsschutz-Versicherung AG (25 for 1.4 million). DEVK and Arag occupy the rear among market sizes.
In addition to Arag, Advocard was also able to reduce its fee again: from more than eleven two years ago to almost four the year before to less than two today. ADAC, Allianz, Deurag, DEVK, Ergo, Roland and Örag have also improved.
Disadvantage for high-growth insurers
For roughly a quarter of a century, Bafin has published annual complaint statistics broken down by insurance company and branch. According to the information, this represents a snapshot that can be influenced by various events. For example, insurers with no complaints are not listed at all.
According to the regulator, the figures are intended to provide “an indicator of the quality and size of the insurance business.” However, the authority notes the limited importance of statistics on the quality of individual companies. Because the data does not allow us to say whether the complaints processed were justified or not.
In addition, the number of claims finally processed by Bafin over a year is compared with the risks insured at the end of the previous year. “Insurers in strong expansion […] are harmed by the denomination of the stock figures, because the increase in stock throughout the year, from which the complaints arise, is not reflected in the statistics,” says the reasoning.
